AGREEMENT

These Terms of Use constitute a legally binding agreement made between you, whether personally or on behalf of an entity (“you”) and Zee Cloud, doing business as Zee Cloud(“Zee Cloud”, “we”, “us” or “our”), concerning your access to and use of the zeecloud.net website as well as any other media form, media channel, mobile website or mobile application related, linked, or otherwise connected thereto (collective, the “Site”). You agree that by accessing the Site, you have read, understood, and agreed to be bound by all of these Terms of Use. IF YOU DO NOT AGREE WITH ALL OF THESE TERMS OF USE, THEN YOU ARE EXPRESSLY PROHIBITED FROM USING THE SITE AND YOU MUST DISCONTINUE USE IMMEDIATELY

Supplemental terms and conditions or documents that may be posted on the Site from time to time are hereby expressly incorporated herein by reference. We reserve the right, in our sole discretion, to make changes or modifications to these Terms of Use at any time and for any reason. We will alert you about any changes by updating the “Last Updated” date of these Terms of Use, and you waive any right to receive specific notice to each such change. It is your responsibility to periodically review these Terms of Use to stay informed of updates. You will be subject to, and will be deemed to have been made aware of and to have accepted, the changes in any revised Terms of Use by your continued use of the Site after the date such revised Terms of Use are posted.

The information provided on the Site is not intended for distribution to of use by any person or entity in any jurisdiction or country where such distribution or use would be contrary to law or regulation or which would subject us to any registration requirement within such jurisdiction or country. Accordingly, those persons who choose to access the Site from other locations do so on their own initiative and are solely responsible for compliance with local laws, if and to the extent local laws are applicable.

The Site is intended for users who are at least 13 years of age. All users who are minors in the jurisdiction in which they reside (generally under the age of 18) must have the permission of, and be directly supervised by, their parent or guardian to use the Site. If you are a minor, you must have your parent or guardian read and agree to these Terms of Use prior to you using the Site.

GUIDELINES FOR REVIEWS

We may provide you areas on the Site to leave reviews or ratings. When posting a review, you must comply with the following criteria: (1) you should have firsthand experience with the person/entity being reviewed; (2) your reviews should not contain offensive profanity, or abusive, racial, offensive, or hate language; (3) your reviews should not contain discriminatory references based on religion, race, gender, national origin, age, marital status, sexual orientation, or disability; (4) your reviews should not contain references to illegal activity; (5) you should not be affiliated with competitors if posting negative reviews; (6) you should not make any conclusions as to the legality of conduct; (7) you may not post any false or misleading statements, and (8) you may not organize a campaign encouraging others to post reviews, whether positive or negative.

We may accept, reject, or remove reviews in our sole discretion. We have absolutely no obligation to screen reviews or to delete reviews, even if anyone considers reviews objectionable or inaccurate. Reviews are not endorsed by us, and do not necessarily represent our opinions or the views of any of our affiliates or partners. We do not assume liability for any review or for any claims, liabilities, or losses resulting from any review. By posting a review, you hereby grant to us a perpetual, non-exclusive, worldwide, royalty-free , fully-paid, assignable, and sub-licensable right and license to reproduce, modify, translate, transmit by any means, display, perform, and/ or distribute all content relating to reviews.

SITE MANAGEMENT

We reserve the right, but not the obligation, to: (1) monitor the Site for violations of these Terms of Use; (2) take appropriate legal action against anyone who, in our side discretion, violates the law of these Terms of Use, including without limitation, reporting such user to law enforcement authorities; and (3) otherwise mange the Site in a manner designed to protect our rights and property and to facilitate the proper functionalizing of the Site.

INTELLECTURAL PROPERTY RIGHTS

Unless otherwise indicated, the Site is our proprietary property and all source code, databases, functionality, software, website designs, audio, video, test, photographs, and graphics on the Site (collectively, the “Content’) and the trademarks, service marks, and logos contained therein (the “Marks”) are owned or controlled by us or licensed to us, and are protected by copyright and trademark laws and of Malaysia, international copyright laws, and international conventions. Except as expressly provided in these Terms of Use, no part of the Site and no Content or Marks may be copied, reproduced, aggregated, republished, uploaded, posted, publicly displayed, encoded, translated, transmitted, distributed, sold, licensed, or otherwise exploited for any commercial purpose whatsoever, without our express prior written permission.

Provided that you are eligible to use the Site, you are granted a limited license to access and use the Site and to download or print a copy of any portion of the Content to which you have properly gained access solely for your personal, non-commercial use. We reserve all rights not expressly granted to you in and to the Site, the Content and the Marks.

USER REPRESENTATIONS

By using the Site, you represent and warrant that: (1) all registration information you submit will be true, accurate, current, and complete; (2) You will maintain the accuracy of such information and promptly update such registration information as necessary; (3) you have the legal capacity and you agree to comply with these Terms of Use; (4) you are not under the age of 13; (5) you will not access the Site through automated or non-human means, whether through a bot, script or otherwise; (6) you will not use the Site for any illegal or unauthorised purpose; and (7) your use of the Site will not violate any applicable law or regulation.

If you provide any information that is untrue, inaccurate, not current, or incomplete, we have the right to suspend or terminate your account and refuse any and all current or future use of the Site (or any portion thereof).

COMMUNICATION

You have given us consent to send email or post notices on the website and/ or social media channels and/ or text messages/ WhatsApp to you when you use zeecloud.net or when you send an email to Zee Cloud. You agree that any communication conducted by Zee Cloud to you in any form such as agreements, notices, disclosures, and other form of communications satisfy any legal requirements bound the laws.

You should read the following sections as part of the privacy policy to understand how your information may be collected or used by us.

COPYRIGHTS

Images of people, products and places on this website are either property of Zee Cloud or our licensor. Unless otherwise noted, all contents included on this website (graphics, logo, text, design, photographs, video, button icons, digital brochures, images) are the property of Zee Cloud or its licensor, partners or affiliates and are protected by Malaysian and international copyright laws. Any unauthorised use of any content or materials on this site is strictly prohibited and may violate copyright and trademark laws, and/or the laws of privacy, publicity and/or communications regulations and statutes.

PROMOTIONS AND PROMO CODES

From time to time, Zee Cloud may offer promo codes which may apply to any, or certain specified purchases made through our website. It is not our obligation to inform any upcoming promotions or promo code beyond the current or existing promotion or promo codes to you. Every promotion and promo code will be subject to specific terms & conditions specified at the time the promo code is issued (including and not limited to the duration of the promotion’s or promo code’s validity) in addition to those mentioned in these Terms.

If you have made a purchase on our website before a promotion is announced, Zee Cloud is not liable to extend the same promotion to you in the interest of fairness to our other customers. We have several ways of notifying the public of our promotions or promo code – we may send you the details via email (if you have signed up for our marketing emails, or we may advertise the promotion or promo code on our Website via a banner or pop-up message, or we may announce it on our social media channels, or we may advertise the promotion or promo code in any or all of our official partner showrooms that are listed on our website.

We have the right to refuse you the use of any promotion or promo code once it is expired or fully redeemed. Depending on the promotion or promo code, a promo code may only be redeemed once for each customer. These codes may not be used in conjunction with any other discounts. Only one promotion/voucher/promo code may be used per order.

FREE GIFTS and PRIZES

Any free gift and/or prize offered by Zee Cloud in relation to our promotions, contests, goodwill, and any other official events is not returnable, replaceable, or resellable to Zee Cloud for cash or credit value.

During promotional periods, Zee Cloud may choose to offer a free gift (for example: a free pillow) with a mattress purchase. If you decide to return the mattress within your 100-night trial period, free gifts must also be returned. If free gifts are not returned, the full retail value of the gift at the time of purchase will be deducted from your refund.

LICENSE

 Any Zee Cloud product, or any part of Zee Cloud, may NOT be reproduced, duplicated, copied, sold, resold, visited or otherwise exploited for any commercial purpose without the express of our written consent. You may not frame or utilise framing techniques to enclose any trademark, logo or other proprietary information (including images, videos, text, page layout or form) of Zee Cloud without express written consent. You may not misuse Zee Cloud services.

GENERAL CONDITION

We reserve the right to refuse service to anyone for any reason at any time. You understand that your content (not including credit card information) may be transferred unencrypted and involve transmissions over various networks and changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks. The headings used in this agreement are included for convenience only and will not limit or otherwise affect these Terms.

NETIQUETTE

Guidelines for commenting on the Zee Cloud Website / Facebook page / Instagram profile and all other social channels.

Please always treat other users and us as you would like to be treated yourself. This means:

Remember that you are speaking to other people and not to a computer

Remain objective and do not use words or language that may be considered offensive towards Zee Cloud or other users

Respect the opinions of others

Respect Zee Cloud business model and operating procedures

Zee Cloud encourages users to comment and maintain a community where everyone can express themselves freely but we also recognise that certain comments may lead to:

• Violent, obscene, profane, hateful and defamatory comments
• Disclosure of personal information such as address or phone number
• Solicitations, advertisements or endorsements for any commercial, financial, political or non-governmental agency or institution
• Comments that suggest illegal activity
• Spamming

When these happen, we reserve the right to remove the comments.

SHIPPING AND DELIVERIES

When you place an order through our site, your product can be shipped to anywhere in West Malaysia for free via a third-party delivery service provider.

You shall expect your order to be shipped straight to your door in 5-7 business days within West Malaysia or 7-14 business days within East Malaysia.

If there is a specific request on the delivery date, it is expected that such arrangement to be made with a minimum of days of advance notice.

During peak sales seasons or due to current circumstances around COVID-19, the delivery time frame may be affected. Any late delivery is regrettable, however, it is not within Zee Cloud’s responsibility to take on such obligation to ensure on time delivery, especially during high sales seasons.

You can return your mattress, with a return delivery fee that will be applied and charged on you. If the delivery is scheduled but it is not able to be delivered due to you are not at home, we reserve the right to charge RM300 as compensation fee if the mattress will be returned.

PAYMENT

Zeecloud.net integrates toyyibPay payment gateway as the payment channel on our website. Our shopping cart is SSL (Secure Sockets Layer) protected, establishing a secure encrypted link between our website and your device, keeping payment and credit card information that you enter, safe, and private.

PRODUCT AVAILABILITY

The availability of our products is subject to change without prior notice.

WARRANTY

Your new Zee Cloud mattress is covered by a 9-year limited warranty from the day of the delivery to your house. Please refer to our warranty section in order to fully understand the applied conditions.

ACCURACY OF INFORMATION

Zee Cloud attempts to be accurate as much as possible. However, we do not warrant that product description or any content of services are accurate, complete, reliable, current, updated or error-free. If a product offered by Zee Cloud is not as described, your sole remedy is to return it in an unused condition. Zee Cloud does its best to display product colours shown on its website as accurately as possible. However, because the colours you see depend on your monitor, we cannot guarantee that your monitor’s display of any colour is accurate. We will not be held responsible for any discrepancy between the colour displayed and the actual perceived colour for the product itself.

LAW

Any dispute or claim relating in any way to your use of Zee Cloud services or to any product sold by Zee Cloud through its website or different channels will be resolved by arbitration, rather than in court. Zee Cloud and you agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated or representative action.

99 NIGHTS TRIAL PERIOD

Within 99 days of purchase, if you are not 100% satisfied with your Zee Cloud mattress, returning is possible, let us know by sending an email to [email protected] or drop us a message through Whatsapp. Once the product is returned to our headquarter and the quality of the mattress is assess, refund will be arranged

Please note that by making a purchase you are also bound to the following conditions:

To be eligible for a return, you must be a Zee Cloud customer and have been sleeping on your mattress for at least 30 days. It takes at least 4 weeks for your body to adjust to a new mattress, as such, we require you to try the mattress for at least 30 days before making a return request.

If the mattress was not directly purchased from Zee Cloud via our official sales channels such as zeeclout.net, Shopee or Lazada, or any unofficial channel it is not eligible for a return or a refund.

To make a return request, send an email with your order number or ID, a receipt or proof of purchase, and reason for returning to [email protected]

The application must be made within the 99 nights trial period, which will take effect from the day purchase. If you are not reachable or do not respond to any of our attempt to contact you, you will not be eligible for a return.

The 99 nights trial is limited to one mattress per household and cannot be used to exchange a mattress for another size. Any upgrade, downgrade, change of size, or wrong order of size, type of our product is not considered to be eligible for a return.

The return policy is applicable to your first mattress purchase only.

Any subsequent mattress you buy from Zee Cloud will not be eligible for 99 nights trial period (e.g. if you buy a Cloud 9 Memory Foam Mattress, you will not be eligible for the applicable trial period on future Cloud 9 Memory Foam Mattress or any new mattress orders). This applies to all new orders from the same customer. Customers may be identified by customer name, delivery address, phone number, email address, or by any other means.

If we have grounds to believe that you are returning the mattress for reasons other than because you’re genuinely dissatisfied with the product we reserve the right to refuse to accept the return, not give you a refund and reserve the right to refuse to sell our products to you in the future. 

If the mattress has been damaged or stained, you will not be granted a return or refund. The returned mattress must be in good condition, even though it will not be resold.

The mattress must be wrapped up securely using its original plastic (or any other plastic that can serve the same purpose) in order to avoid the product from getting dirty or damaged during transportation. Failing this, Zee Cloud will charge RM300 as a compensation fee (for cleaning and repairs purposes) which will be deducted promptly from the refund amount.

The 99 nights count will start from the shipping date.

REFUNDS

Refund policy (indicate the condition to get refund, how monies will be refunded)

Refund progress will be verify before we will refund the amount. The product has to be back at one of our warehouses or associated charities for verification. The refund will be sent to the card or in the account that you have used to purchase it or direct transfer to your TnG wallet or any bank account with payment slip as a transaction proof for our record. 

NON-REFUNDS 

Non-refundable policy practiced withholds a consumer’s right from raising a dispute in the event they face an issue with their payment. (duplicate transaction, transaction error, etc.)

Thus, if the customer request for a refund, merchant will still need to act accordingly.

MISCELLANEOUS

These Terms of Use and any policies or operating rules posted by us on the Site or in respect to the Site constitute the entire agreement and understanding between you and us. Our failure to exercise or enforce any right or provision of these Terms of Use shall not operate as a waiver of such right or provision. These Terms of Use operate to the fullest extent permissible by law. We may assign any or all of our rights and obligations to others at any time. We shall not be responsible or liable for any loss, damage, delay, or failure to act caused by any cause beyond our reasonable control.
